By using our Services (as defined below), you agree that your personal information will be handled as described in this Policy. Your use of our Services and any dispute over privacy is subject to this Policy and our Terms of Use, available at https://www.probaseapp.com/terms-of-service, including their applicable terms governing limitations on damages and the resolution of disputes. References to "Services" include our website and mobile application (the "Mobile App").
Additional Terms for Marketplace Participants. If you participate in the ProBase Marketplace as a service professional, your use of the Marketplace is also governed by the ProBase Marketplace Agreement, available at https://www.probaseapp.com/marketplace-agreement. The Marketplace Agreement contains additional terms regarding data collection, use, and sharing specific to Marketplace participation.

1. Scope
Except as otherwise described below, this Policy applies to our personal information processing activities including, but not limited to: visitors of our website where this Policy is posted, including https://www.probaseapp.com/ (the "Site") and users of our mobile application (the "Mobile App"); individuals who sign up for, or create an account with us to access and use certain features of our services; individuals who participate in the ProBase Marketplace as service professionals or customers; individuals who register for or participate in our events, surveys, sweepstakes, or research conducted by us; individuals who subscribe to receive news, information, and marketing communications and other materials from us; and individuals who communicate or otherwise interact or engage with us or the services available through our Site, Mobile App, or other online services (collectively referred to as the "Services").
Additional Notices. Depending on how you interact or engage with us, we may provide you with additional or supplemental privacy notices with additional details about our privacy practices. These additional notices will control to the extent there is a conflict with this Policy, with respect to your personal information that is subject to that additional notice.
2. Personal Information Collected
We collect personal information directly from you, from third-party sources, and automatically through your use of the Services. To the extent permitted by applicable law, we may combine the personal information we collect from publicly available or third-party sources. The personal information we may collect varies depending upon your use of our Services and our interactions with you.
Personal Information Collected Directly
We may collect the following personal information directly from you:
Contact Details and Identifiers. We may collect certain contact details and other personal identifiers such as your name, address, email address, phone number, and any other information you choose to provide. We collect your name and phone number for purposes of sending you marketing communications and communications about the Services. The SMS consent data that we collect will not be shared with third parties; however, we may share such information with our service providers who provide functions on our behalf and at our direction, including those who assist us with our text messaging service. Our service providers cannot use the information we share with them for their own purposes.
Account and Profile Information. If you sign up for an account with us, we collect information associated with your account, including your name, contact information, account credentials (such as your password or other information for account login authentication), and any other information you choose to provide with your account or that we obtain in connection with your account. Depending on how you interact with us, this information may also include credit card or other billing information.
Marketplace Verification and Approval Information. If you apply to participate in the ProBase Marketplace as a service professional, we collect additional information to verify your identity and qualifications, including: Social Security Number (SSN) or Tax Identification Number; driver's license or government-issued identification; proof of insurance (general liability, auto, and/or worker's compensation as applicable); work history and professional experience; service capabilities and certifications; and vehicle information. We may also collect demographic information such as gender, ethnicity, and date of birth for identity verification, compliance, and reporting purposes.
Business and Service Information. If you are a service professional using our business management tools, we may collect information related to your business operations, including service area and coverage zones, customer information you input into the platform, scheduling and route information, equipment inventory and maintenance records, chemical and treatment logs, job notes and service records, and pricing and invoicing data.
User-Generated Content. We also may collect user-generated content you provide when using the Services, and any other content or information you choose to provide. We, or others, may store, display, reproduce, publish, or otherwise use user-generated content, and may or may not attribute it to you. Others may also have access to user-generated content and may have the ability to share it with third parties. If you choose to submit content that includes personal information such as your name or username, image, or likeness, you acknowledge that such content may be available to other users and the public. We are not responsible for the other users' or the public's use of available content, so you should exercise caution before choosing to share personal information by these means.
We or others may reproduce, publish, distribute or otherwise use User Content online or offline in any media or format (currently existing or hereafter developed). Others may have access to this User Content and may have the ability to share it with third parties across the Internet. Any User Content you provide in these areas may be read, collected, and used by others who access them. We do not control who will have access to the information that you choose to make public and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. This Policy does not apply to any information that you disclose publicly, share with others or otherwise upload, whether through the Services or otherwise. We are not responsible for the accuracy, use or misuse of any content or information that you disclose or receive through the Services. We may publish your name, voice, likeness and other personal information that is part of your User Content, and we may use the content, or any portion of the content, for advertising, marketing, publicity and promotional activities.
Promotional Information. If you agree to receive marketing communications from us, we may collect your contact details, preferences, and if relevant, information about your account and profile, including the Services and features you use. If you participate in offers, sweepstakes, programs, or promotions we offer, we may also collect certain demographics details and any other information that may be required by applicable law.
Responses and Feedback. If you participate in surveys, questionnaires, or research conducted by us, such as for market research, user satisfaction, or other similar purposes, we may collect your responses and feedback, and any other information you choose to provide.
Preferences and Other Requests. We also may collect information about your preferences, including communications preferences, preferences related to your use of our Services, and any other preferences or requests you provide when interacting with us.
Personal Information Collected from Third Parties
We may also collect and receive certain personal information about you from third party sources, such as from business partners, data analytics and marketing providers, operating systems and social media platforms, publicly available sources, and service providers or other third parties who provide services or perform functions on our behalf.
In addition, we may collect the following personal information from third-party sources:
Social Media Information. While using our Services, you may choose to interact with or enable sharing information or content through various platforms or social networking websites. If you choose to share content, we may collect or receive personal information about you that you have provided to that platform and/or social networking website. For example, we may collect information related to your account and profile, public profile picture and postings, and other similar information available on your profile.
Lead and Prospect Information. We may receive lead and prospect information from third parties about prospective customers that may be interested in our Services. We may also engage with third parties to enhance or update our customer information. For example, we may receive certain personal information about you from data analytics and marketing providers for marketing and advertising purposes, and for purposes of reaching new customers.
Background Check Information. For service professionals applying to participate in the Marketplace, we may receive background check information from third-party consumer reporting agencies, including criminal history, driving records, and identity verification results, subject to your authorization and applicable law.
Personal Information Collected Automatically
We and our third-party service providers may automatically collect or derive certain personal information about you related to your use of our Services, including through the use of cookies, pixel tags, and other similar technologies. The personal information automatically collected may include:
Device and Browsing Information. When you use our Services, we may collect browser type, domain name, page views, access times, date/time stamps, operating system, language, device type, unique ID, mobile device identifiers (such as Apple IDFA or Android Advertising ID), Internet service provider, referring and exiting URLs, clickstream data, and other similar device and browsing information.
Activities and Usage. We also may collect activity information related to your use of the Services, such as information about the links clicked, searches, features used, pages viewed, time spent within the Services, your interactions with us within the Services, and other similar activity and usage information.
Location Information. We also may collect or derive general location information about you, such as through your IP address.
Precise Geolocation During Service Delivery. If you are a service professional participating in the Marketplace, we may collect precise GPS location data from your device during service delivery. This location tracking is used to verify service completion, optimize routing, ensure customer safety, and support dispute resolution. You may be required to enable location services as a condition of Marketplace participation. Location tracking occurs only during active service delivery periods and can be managed through your device settings, though disabling location services may affect your ability to participate in the Marketplace.
3. Purposes for Collecting and Processing Personal Information
Generally, we may collect, use, disclose and otherwise process the personal information we collect for the following purposes:
Services and Support. To provide and operate our Services, manage your account, communicate with you about your use of the Services, provide troubleshooting and technical support, and for other similar support purposes, and to otherwise run our day-to-day operations.
Marketplace Operations. To facilitate connections between service professionals and customers, verify service professional qualifications and identity, process payments, resolve disputes, and ensure the safety and quality of Marketplace services.
Analytics and Improvement. To better understand how users access and use the Services, and for other research and analytical purposes, such as to evaluate and improve the Site, our Services, and business operations, including to develop our Services and their features, and for internal quality control and training purposes.
Communication. To respond to your inquiries, provide notices required by law, send you information about your account and our Services, and send other informational or administrative messages.
Customization and Personalization. To tailor content we may send or display within the Services, to provide personalized help and instructions, and to otherwise personalize your experiences while using the Services.
Marketing and Advertising. To contact you about new products, services, and other offerings we think may be of interest to you. We may also use your personal information to facilitate transmittal of information or advertisements that may be useful, relevant, valuable, or otherwise of interest to you.
Contests and Promotions. To facilitate sweepstakes, contests, and other promotions we may offer, including to contact you about your entry and to process prizes.
Research and Surveys. To administer surveys, questionnaires, or other research for purposes such as market research, user satisfaction, or other similar purposes.
Insight Development and Data Enhancement. To engage in data analysis and enhancement activities to help us improve and personalize our Services and develop insights which we may use to create products and services.
Planning and Managing Events. To plan and host events or webinars for which you are registered or at which you may be in attendance.
Security, Protection of Rights, and Fraud Mitigation. To protect the Services and our business operations, to prevent and detect fraud, unauthorized activities and access, and other misuse, to address security issues that may arise, and for other similar purposes. We also collect, process, and disclose personal information for purposes of exercising and defending our legal rights, preventing, investigating, and remedying harm, and protecting our rights, privacy, safety, or property, and that of you, our other users, affiliates, or others.
Compliance and Legal Process. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding or in response to a subpoena, warrant, court order, or other legal process, or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority. This includes sharing information to address cybersecurity incidents.
Auditing, Reporting, and Other Internal Operations. For activities related to auditing interactions with consumers, internal business reporting, and other internal business operations.
General Business and Operational Support. For purposes of engaging in business transactions and carrying out other general business activities related to our business operations and day-to-day activities. In connection with a merger, acquisition, bankruptcy, dissolution, or other similar transactions or proceeding, we may disclose personal information as part of the due diligence process or as needed to complete the transaction.
4. Disclosures of Personal Information
We may share or disclose personal information with the following types of parties for business purposes as described in this Policy:
Service Providers. We may disclose personal information with third-party service providers that perform services on our behalf. These may include, among others, website hosting providers, data storage providers, call centers and technical support, payment processing, data analytics, customer relationship management platform providers, marketing and advertising service providers, survey administration and management providers, and other service providers who support our business.
Advisors and Agents. We may disclose personal information with third-party advisors, agents, and other parties with whom we have a business relationship, such as parties assisting us with legal, consulting, accounting, or advisory services.
Affiliates and Subsidiaries. We may share personal information with our affiliated companies for the purposes and uses described in this Policy.
Customer Information Shared with Service Professionals. When a customer books a service through the Marketplace, we share certain customer information with the assigned service professional to enable service delivery. This includes the customer's name, service address, contact information, service requests and special instructions, property access information, and relevant service history. Service professionals are contractually obligated to use this information solely for the purpose of providing the requested services and in accordance with our Marketplace Agreement.
Service Professional Information Shared with Customers. When a service professional is assigned to a customer through the Marketplace, we share certain service professional information with the customer, including the professional's name, profile photo, business name, ratings and reviews, and estimated arrival information.
Business Partners and Advertising Partners. We may share personal information with our business partners for our joint marketing initiatives. We may also share certain personal information with our business partners and advertising partners for our general advertising and marketing purposes.
Third-Party Services. If you choose to engage with third-party platforms, websites, apps, or other linked services, we may disclose your personal information to those parties.
Required by Law. We may disclose your personal information to regulators, government entities, and law enforcement in response to subpoenas, court orders, and other lawful requests by public authorities, including to meet national security or law enforcement requirements. We may also disclose personal information where we believe it is necessary to comply with the law or legal processes, to respond to claims, and to protect our rights, property, interests, or safety, and that of you, our other users, affiliates, third parties, or the general public.
Business Transactions. We may disclose personal information as part of an actual or prospective corporate transaction, including, but not limited to, a merger, acquisition, bankruptcy, dissolution, or other similar event or proceeding.
We may also disclose personal information related to litigation and other legal claims or proceedings in which we are involved, as well as for our internal accounting, auditing, compliance, recordkeeping, and legal functions.
Other Disclosures. We may disclose personal information in other ways not described above that we notify you of or that we obtain your consent for, or that are otherwise authorized or required by law.
5. Cookies and Other Tracking Mechanisms
We and our third-party service providers use cookies, pixels, local storage objects, log files, and other mechanisms to automatically collect browsing, activity, device, and similar information within our Services. We use this information to, for example, analyze and understand how users access, use, and interact with our Services, to identify and resolve bugs and errors in our Services, to assess secure, protect, optimize and improve the performance of our Services, as well as for marketing and analytics purposes, and to personalize content in our Services.
Cookies. Cookies are alphanumeric identifiers we transfer to your device's hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Services, while others are used to enable a faster log-in process, support the security and performance of the Services, or allow us to track activity and usage data within the Services.
Pixel Tags. Pixel tags (sometimes called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. While cookies are stored locally on your device, pixel tags are embedded invisibly within web pages and online content. We may use these, in connection with our Services to, among other things, track the activities of users, and help us manage content and compile usage statistics. We may also use these in our emails to let us know when they have been opened or forwarded, so we can track response rates and gauge the effectiveness of our communications.
Software Development Kits (SDKs). We may use third-party software development kits ("SDKs") in our Mobile App. An SDK is a collection of software tools and resources third party developers often use to build applications for specific platforms. SDKs allow us, our service providers, and third-party partners to collect information about your device and usage patterns. We use SDKs to, for example, add features or functionality to our Mobile App, provide us with analytics regarding your use of our Mobile App, to integrate with social media, or to facilitate advertising.
Third-Party Analytics and Tools. We use third party tools, such as Google Analytics, which are operated by third party companies. These third-party analytics companies may use cookies, pixels, and other similar tools to collect usage data about our Services in order to provide us with reports and metrics that help us evaluate usage of our Services and improve performance and user experiences. You can also download the Google Analytics Opt-out Browser Add-on to prevent data from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout.
Cross-Device Tracking. We and our third-party providers may use the information we collect about you within our Services and on other third-party sites and services to help us and these third parties to identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.).
Third-Party Advertising. We work with third parties, such as ad networks, analytics, marketing partners, and others ("third-party ad companies") to personalize content and display advertising within our Services, as well as to manage our advertising on third-party sites. We and these third-party ad companies may use cookies, pixels tags, and other tools to collect browsing and activity information within our Services (as well as on third-party sites and services), as well as IP address, unique ID, cookie and advertising IDs, and other online identifiers. We and these third-party ad companies may use this information to provide you more relevant ads and content within our Services and on third-party sites, and to evaluate the success of such ads and content.
Custom Lists and Matching. We may share or make available certain customer list information (such as your name, email address and other contact details) with third parties so that we can better target ads and content to you across third party sites, platforms and services, and in some cases, these third parties may help us to enhance our customer lists with additional demographic or other information, so we can better target our advertising and marketing campaigns.
6. Your Privacy Choices
We make available several ways that you can manage your preferences and privacy choices. If you delete or block cookies, you may need to reapply these preferences to each browser and/or device used to access our Services.
Account and Profile Information. You may access, update, and delete certain of your personal information by accessing and adjusting your account information or settings directly within our Services. If you no longer wish to use the Services, you may close your account by sending a request to privacy@probaseapp.com. When closing an account, we remove certain personal information from your account but may keep certain information for fraud mitigation and tax purposes.
Marketing Communications. We may send periodic promotional emails or other similar communications to you, in accordance with applicable law. You may opt out of our marketing communications by following the opt-out instructions contained in the communications, or by contacting us at privacy@probaseapp.com. Please note that it may take a reasonable period of time to process your request, and your request does not affect communications that we have already sent. Please also note that if you opt out of our marketing communications, we may still send you non-promotional messages, such as messages about your account or our ongoing business relations.
SMS and Text Messages. You may opt out of text or SMS messages by replying STOP to any text message you receive from us or by contacting us at privacy@probaseapp.com.
Push Notifications. If you are receiving push notifications from us, you may manage your preference through your device settings, or by contacting us at privacy@probaseapp.com.
Mobile Settings. You can manage the type of push notifications you receive from us by adjusting your device settings or by modifying the settings within our Mobile App. In addition, our Mobile App may include third-party advertising and analytics. You can change your targeting and advertising preferences for the Mobile App by adjusting the in-app settings.
Location Settings. If you have enabled location services, you may adjust your settings through your device settings. Please note that disabling location services may affect certain functionality of the Services, including Marketplace participation.
Do Not Track. Our Services do not respond to Do Not Track signals.
Opt-Out Preference Signals. Certain jurisdictions require that we respond to opt-out preference signals. Opt-out preference signals are signals sent by a platform, technology, or mechanism, such as the Global Privacy Control, on behalf of a user that communicate a user's choice to opt out of the sale or sharing of their personal information. If our Services detect an opt-out preference signal from your device or browser, we will treat it as a valid request to opt out of the "sale" and "sharing" of personal information, and out of "targeted advertising," under applicable privacy laws. Depending on your activity, the opt-out may apply to personal information collected in other contexts as well. If you come to our site from a different device or from a different browser on the same device, or if you clear your cookies, you will need to opt-out again, or use an opt-out preference signal, for that browser and/or device as well.
